Legal Notice

On a daily basis, the head of activities named in the request is obliged to obtain by telephone a tactical approval for the start of activities from the competent air traffic control and also inform them about the end of using the defined airspace. The head of activities shall be available on their mobile phone as specified in this request for the whole duration of the activity. Pursuant to Article 72 of the Ordinance on the Rules of the Air and Article 15 of the Ordinance on Airspace Management (Official Gazette of the Republic of Croatia No. 138/2009) the competent air traffic control and the airspace management cell retain the right of changing the conditions laid down herein. Upon the request of the competent air traffic control or the airspace management cell, the head of activities shall terminate all activities in the abovementioned defined airspace as soon as possible and confirm by telephone that all activities have been terminated. Pursuant to the Ordinance on the Rules of the Air SERA 3145, Articles 9 and 25, aircraft pilots involved in activities in the abovementioned defined airspace shall avoid active prohibited, restricted and danger areas. In case of activation of such and similar areas, the competent air traffic control can deny its approval for the beginning or continuation of activities in the abovementioned defined airspace. The competent air traffic control performs the separation of the flights subject to separation (according to the classification of airspace) from the determined areas (see AIP GEN 1.7). If the user does not comply with these requirements, their use of controlled airspace shall be limited to the lowest extent possible or completely prohibited due to the safety, regularity and efficiency of air traffic. The user must obtain, if applicable:

  • the approvals for the organization of an air show pursuant to Article 21 of the Air Traffic Act (Official Gazette of the Republic of Croatia No. 69/2009, 84/2011, 54/2013, 127/2013 and 92/2014).
  • the approval for performing aircraft take-offs/landings and parachute jumps on natural operating sites pursuant to Article 19 of the Air Traffic Act (Official Gazette of the Republic of Croatia No. 69/2009, 84/2011, 54/2013, 127/2013 and 92/2014), Article 18 of the Ordinance on the Rules of the Air and Article 15 of the Ordinance on Parachuting (Official Gazette of the Republic of Croatia No. 65/2015).
  • the approvals and consents pursuant to Article 18.b of the Air Traffic Act (Official Gazette of the Republic of Croatia No. 69/2009, 84/2011, 54/13, 127/2013 and 92/2014) and ASO-2013-004 (Revision No. 5/14.04.2016.), regarding the use of registered landing and take-off areas.
  • the approval of the competent local and regional governments for performing the activity concerned pursuant to Article 20 of the Ordinance on the Rules of the Air.
  • the approval for flying an unmanned aircraft and non-controlled self-powered flying objects pursuant to Article 18 of the Ordinance on the Rules of the Air.
  • the approval for aerial photography and the use of aerial photographs, pursuant to Articles 4, 5, 7, 8, 9 and 10 of the Regulation on Aerial Photography (Official Gazette of the Republic of Croatia No. 70/2016).
  • the approval of the Ministry of Foreign and European Affairs and the Ministry of the Interior of the Republic of Croatia regarding the inviolability of state borders pursuant to international agreements and the regulations of the Republic of Croatia.
  • the approval of competent state authorities of the neighboring states for releasing sky lanterns in the airspace above their territories.
  • report a public gathering to the competent police administration in accordance with the Law on Public Gathering (Official Gazette of the Republic of Croatia No. 128/1999, 90/2005, 150/2005 and 78/2012).
  • applicable certificates, approvals or other licenses for aircraft operations pursuant to Article 59 of the Air Traffic Act.
  • approvals for flying below the minimum safe altitude, pursuant to Article 18 of the Ordinance on the Rules of the Air.
  • approvals for displaying the public fireworks pursuant to Article 32 of the Explosive Substances Act (Official Gazette of the Republic of Croatia No. 178/2004, 109/2007, 67/2008 and 144/2010) and Articles 4 and 18 of the Ordinance on Public Fireworks (Official Gazette of the Republic of Croatia No. 131/2008, 69/2012 and 130/2015).
  • other relevant approvals (e.g. of the competent local and regional governments, the operators of controlled and uncontrolled aerodromes, the competent police administration, the Ministry of Environment and Energy, the Harbormaster's Office etc.).
